A frequent case in the practice of development business in Russia is the direct collision of a developer's business plans with the judicial practice of considering disputes related to real estate properties where a development project was planned. Property owners, developers and their financial interests become hostages of long periods of judicial disputes considered by the arbitration courts system in the Russian Federation. An aggravating factor is a significant recent increase in the segment of judicial proceedings in cases of insolvency (bankruptcy), which in some cases could potentially put an end to all the initial optimistic financial plans of the developer and its financial partners.
On 17.06.2021 the Supreme Court of the Russian Federation (Presiding Judge I.A.Bukina ) considered a similar dispute in the case on insolvency (bankruptcy) of the Moscow business company - debtor, Dmitrovka LLC, (Case № A40-71749/2015). This company used to be part of the rather large Trade and Industrial Group Terna.
A.T.Legal and its attorneys Nikolay Titov and Pavel Ganin defenede the interests of the developer owner, Seliger Park, in the Supreme Court of the Russian Federation, and earlier in lower courts.
Since 2020, A.T.Legal has represented a developer in a whole group of complex legal disputes related to real estate properties where the development project is being implemented. The team of A.T.Legal solved a whole group of complex tasks related to valuation, taxation, as well as mediation of interests of different parties in consideration of disputes involving the company.
